DMCA & Copyright Policy

Please read this page carefully. Questions? Write to us any time — we are happy to explain.

Last updated: 19 October 2026. Effective date: 19 October 2026. As a creative agency, Dzone Ads knows how much effort goes into original work. This DMCA & Copyright Policy explains how we respect intellectual property, how rights owners can ask us to remove material from https://dzoneads.com, and how a person whose material was removed can respond. It covers both Indian law and the notice-and-takedown process of the United States Digital Millennium Copyright Act (DMCA).

1. Our respect for intellectual property

Original design is the heart of our business. We expect our team, our clients and visitors to respect the copyright, trademarks and other rights of creators. In our own work we:

  • create original designs, layouts, illustrations and copy for client projects;
  • use fonts, stock images, icons, music and video clips only under a suitable licence, under an open licence, or when supplied by the client with a confirmation that they have the right to use them;
  • credit open-licence images used on our website on our image credits page;
  • ask clients to confirm that the logos, photos and text they send us are theirs or are licensed to them, as set out in our Terms & Conditions.

Even with care, mistakes can happen. If you believe that material on our website infringes your copyright, please tell us using the process below and we will act promptly.

2. Laws this policy follows

Dzone Ads is based in Kerala, India, so Indian law applies to our website. This policy is designed to follow:

  • the Copyright Act, 1957 and the Copyright Rules, 2013, including the notice procedure for transient or incidental storage under Section 52(1)(c) and Rule 75;
  • the Information Technology Act, 2000, in particular Section 79 (exemption from liability for intermediaries in certain cases), and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, to the extent they apply to content posted by users, such as blog comments.

Because we also serve international visitors, we accept notices that follow the format set out in the US DMCA, 17 U.S.C. §512. We follow the DMCA notice-and-takedown process as a matter of good practice. Dzone Ads is not a US company, and following this process does not mean that we accept the jurisdiction of US courts for any other purpose.

3. What this policy covers

This policy applies to content on dzoneads.com, including:

  • text, images, graphics and videos we publish on our pages and blog;
  • work shown in our portfolio;
  • products and package images in our online shop;
  • comments or other content posted by visitors, where those features are enabled.

It does not cover content on other websites or platforms, such as our social media pages on Facebook, Instagram, Twitter (X) or LinkedIn. Those platforms have their own copyright reporting tools, which you should use for content hosted there. You may also contact us directly and we will review the matter.

If your concern is about a trademark, privacy, defamation or other non-copyright issue, please contact us at [email protected] and describe the issue. We will review it under the relevant law, although the specific procedures below are written for copyright.

4. How to file a takedown notice

To help us act quickly, your notice should contain the information below. A notice that includes everything in both lists will satisfy both the DMCA and Indian requirements.

4.1 Required elements under the DMCA (17 U.S.C. §512(c)(3))

  1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf. A typed full name at the end of an email is acceptable as an electronic signature.
  2. Identification of the copyrighted work you claim has been infringed. If several works are covered by one notice, a representative list of those works.
  3. Identification of the material you claim is infringing and that you want removed or disabled, with information reasonably sufficient for us to locate it — ideally the exact URL of the page and a description of the item (for example, “the third image on the page”).
  4. Information reasonably sufficient for us to contact you, such as your name, postal address, telephone number and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

4.2 Additional details for notices under Indian law

Under Rule 75 of the Copyright Rules, 2013, a complaint asking us to stop providing access to a copy of a work should be in writing and should also include:

  • a description of the work, with adequate information to identify it;
  • details establishing that you are the owner of the copyright, or an exclusive licensee, in the work;
  • details establishing that the copy we are storing is an infringing copy of your work, and that the allegedly infringing act falls under Section 51 of the Copyright Act and is not covered by an exception under Section 52 or any other provision of the Act;
  • details of the location (URL) where the copy is available;
  • details of the person, if known, responsible for uploading the allegedly infringing copy;
  • an undertaking that you will file an infringement suit in a competent court against the person responsible, and produce the court’s orders before us within 21 days of the date of your notice;
  • your signature.

4.3 Helpful extras

  • A link to, or copy of, your original work.
  • Evidence of ownership, such as an earlier publication date, original files or a registration certificate if you have one.
  • If you are acting for someone else, proof of your authority to act.

5. Where to send your notice

Send your notice by email to [email protected] with the subject line “Copyright takedown notice”. You may also send it by post to: Dzone Ads, Pulikkal, Malappuram, Kerala, India. Email is the fastest way to reach us. If you need to discuss the notice, you can call or WhatsApp +91 97478 37026, but please send the notice itself in writing.

6. What happens after we receive a notice

  1. Acknowledgement. We will confirm that we have received your notice, normally within 24–48 hours.
  2. Review. We will check that the notice is complete. If something important is missing, we will ask you for it. An incomplete notice may delay action.
  3. Action. If the notice is valid, we will remove or disable access to the material promptly. For notices under Rule 75 of the Copyright Rules, 2013, we will disable access within 36 hours of receiving a complete notice. For content posted by users, we will act within the timelines that apply under the IT Rules.
  4. Notification. Where the material was posted by a user or supplied by a client, we will make reasonable efforts to inform that person and send them a copy of the notice (we may remove your personal contact details where appropriate).
  5. Follow-up. For notices under Indian law, if we do not receive an order from a competent court within 21 days of your notice directing us to continue preventing access, we may restore access to the material, as the Copyright Rules permit.

Where the material is our own content (for example, an image we used on a blog post), we will review it, and if we cannot confirm a licence or valid exception, we will remove or replace it.

7. Counter-notice process

If material you posted or supplied was removed and you believe this was a mistake, or that you have the right to use it, you may send us a counter-notice.

7.1 Required elements under the DMCA (17 U.S.C. §512(g)(3))

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location (URL) where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original notice or their agent.

Where your counter-notice relates to Indian law, please also include the facts supporting your right to use the material (for example, a licence, your own authorship, or a fair dealing exception under Section 52 of the Copyright Act, 1957), and confirm that you consent to the jurisdiction of the courts at Malappuram, Kerala, India.

7.2 What we do with a counter-notice

We will send a copy of a valid counter-notice to the person who filed the original notice. Under the DMCA process, unless the complainant tells us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material between 10 and 14 business days after receiving the counter-notice. Under Indian law, restoration is governed by the 21-day court-order period described in Section 6. We may decide not to restore material where we have good reason, such as a clear breach of our Terms & Conditions.

8. Repeat infringer policy

We take repeated infringement seriously. Where appropriate and in our discretion, we will:

  • disable commenting for, or close the website account of, any user who repeatedly posts infringing material;
  • decline or end projects with clients who repeatedly supply material they do not have the right to use, after giving them a chance to provide proof of rights;
  • keep a record of valid notices to help identify repeat infringers.

A counter-notice that is upheld, or a notice that turns out to be mistaken, will not count against a user under this policy.

9. Misrepresentation warning

Please make sure your notice or counter-notice is accurate. Under 17 U.S.C. §512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and legal fees, incurred by the alleged infringer, the copyright owner or the service provider. Making a false statement in a notice may also have consequences under Indian law.

Before sending a notice, consider whether the use might be licensed or covered by fair dealing or fair use — for example, short quotations for review or commentary. If you are unsure whether material infringes your rights, you may wish to seek legal advice first.

10. Our own content and image credits

The text, graphics, layouts and original designs on dzoneads.com are owned by Dzone Ads or our licensors, and portfolio pieces are shown with respect for our clients’ rights, as explained in our Disclaimer. Please do not copy our content or present our portfolio work as your own.

Some photographs and illustrations on our website are open-licence images from third-party creators. We credit these, with the creator and licence where required, on our image credits page. If you are the creator of an image on our website and believe the credit is missing or wrong, please contact us and we will correct it.

If you find our original work used elsewhere without permission, we would appreciate a message at [email protected].

11. Changes to this policy

We may update this policy from time to time, for example to reflect changes in Indian or international copyright law or in how our website works. The “Last updated” date at the top shows when it was last changed.
